Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the EchoWish website and services at echowish.ai (“Service”), operated by EchoWish (“we,” “us,” or “our”), a company registered in Finland.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not use the Service. You must be at least 16 years old to use the Service. If you are under 18, you confirm that you have your parent or guardian's consent.

2. Service Description

EchoWish provides AI-generated custom songs based on information you provide, including recipient details, occasion, memories, and preferences. We also offer physical products including printed QR greeting cards and custom music magnet keepsakes.

Our songs are created using artificial intelligence technology. While we strive for high quality, AI-generated content is produced by machine learning models and may occasionally produce unexpected results. Each song is generated uniquely based on your inputs, but we cannot guarantee that outputs will be entirely unique or free from similarities to other AI-generated works.

3. Orders and Payment

By placing an order, you agree to pay the listed price for your selected package. All prices are displayed in US dollars (USD) unless otherwise indicated. Applicable taxes (including VAT for EU customers) are calculated at checkout based on your location.

Payments are processed securely through Stripe. We do not store your payment card details. By making a purchase, you also agree to Stripe's terms of service.

4. Refund and Cancellation Policy

We want you to be happy with your song. If you are not satisfied after using your included revisions, you may request a full refund within 14 days of your original purchase. Refund requests can be submitted by contacting us at support@echowish.ai.

For physical products (QR greeting cards and keepsake magnets), refunds are available if the item arrives damaged or defective. Once a physical product has been sent to production, we cannot cancel or modify the order.

Refunds are processed to the original payment method and may take 5-10 business days to appear on your statement.

5. Intellectual Property and Song Ownership

Upon full payment, you receive a personal, non-exclusive, worldwide license to use, share, download, and play your custom song for personal, non-commercial purposes. This includes sharing via social media, playing at private events, and gifting to the intended recipient.

You acknowledge that songs are generated by artificial intelligence and that the legal status of copyright in AI-generated works varies by jurisdiction and is subject to evolving law. We make no representation or warranty that copyright will vest in any generated song. EchoWish retains ownership of its underlying technology, platform, AI models, and processes.

We may use anonymized or aggregated data about song creation patterns to improve our Service, but we will not publicly share your specific song, personal stories, or recipient information without your consent.

6. User-Submitted Content

When you place an order, you provide personal information about the song recipient, including their name, your relationship, memories, and other details (“User Content”). You represent that you have the right to share this information and that it does not violate any third party's rights.

By submitting User Content, you grant EchoWish a limited license to use this information solely for the purpose of creating your song and fulfilling your order. We do not sell your User Content to third parties or use it for AI model training.

You may request deletion of your User Content at any time by contacting support@echowish.ai. We will delete your data within 30 days, except where retention is required by law.

7. Prohibited Uses

You agree not to:

• Use the Service for any commercial purpose, including reselling songs or using them in commercial productions, without our prior written consent
• Create songs containing hateful, defamatory, abusive, or illegal content
• Attempt to reverse-engineer, copy, or replicate our technology or platform
• Use automated tools (bots, scrapers) to access or interact with the Service
• Impersonate another person or misrepresent your identity
• Use the Service to develop a competing product or service

We reserve the right to refuse service and cancel orders that violate these terms.

8. Revisions

Depending on your package, you receive a set number of revisions (1 for EchoWish Lite, 2 for EchoWish Plus and Keepsake). Revisions allow you to request changes to genre, lyrics, or additional details. We generate new versions based on your feedback, but cannot guarantee that the revised output will match your exact expectations, as results depend on AI generation.

9. Physical Products

QR greeting cards are printed and shipped by our fulfillment partner. Shipping times vary by destination. For keepsake music magnets, production and international shipping may take 2-4 weeks.

For EU customers, keepsake magnets ship from outside the EU. Local import VAT and customs duties may apply upon delivery, depending on your country. These fees are determined by your local customs authority and are not included in the product price.

10. Account and Termination

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. Upon termination, your license to any purchased songs remains valid, but your access to the platform and account features may be revoked.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated songs will meet your specific expectations. The quality and style of generated songs depend on multiple factors including AI model capabilities and the information you provide.

12. Limitation of Liability

To the maximum extent permitted by applicable law, EchoWish shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you paid for the specific order giving rise to the claim, or EUR 100, whichever is greater.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Finland, without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be submitted to the courts of Helsinki, Finland, which shall have exclusive jurisdiction.

If you are a consumer within the European Union, you also have the right to submit complaints to the Online Dispute Resolution platform of the European Commission at https://ec.europa.eu/consumers/odr.

15. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you via email or through the Service.
